1: Format of the Contract.

 

The following conditions of sale apply to all goods supplied by Big Brother Systems Ltd. (The Company) Unit 7, Parkhall Business Village, Stoke on Trent, Staffs, ST3 5XA, via www.bigbrothersystems.com or direct from our showroom,and does not affect your statutory rights. No contract exists between The Buyer and The Company for the sale of any goods until we have received and accepted your order including payment in full cleared funds. Acceptance of your order will be sent to you by way of email at the point of dispatch of the products. Acceptance of the order will then be treated as complete. For reference an acknowledgement of your order will be emailed to you, but the contract to buy the goods will not take place until the Company have shipped your order. These Terms and Conditions are available in our showroom and via our online shop www.bigbrothersystems.com, and confirmation and means that you have accepted these Terms and Conditions.

The contract is subject to your right of cancellation.

 

2: Detailed Description and Price of the goods

 

The detailed description and cost of the goods you order will be as shown on the Big Brother website at the time you place your order. All goods are subject to availability. If, on receipt of your order the goods are not available in stock, we will inform you as soon as possible and advise you of any delay period. You can then decide to wait or we will refund or re-credit you for any sum that has been paid by you or debited from your credit card for the items. We put a lot of dedication into the site to ensure that prices shown on the shop are accurate at the time you place your order. If any mistakes are found, we will inform you as soon as possible and offer you the option of amending your order to the correct price, or cancelling your order. If we do not receive an order confirmation within 14 days of notifying you of the mistake, the order will be automatically cancelled. If you do cancel, we will refund or credit you for amounts that has been paid by you or debited from your credit/debit card for the goods.

In addition to the original cost you may be asked to pay the delivery charge for the goods.

Special offers: we offer a Buy 3 Get 1 Free on a selection of our products, to qualify the 3 items must be purchased in 1 transaction and the free item will be the same as the first 3.   It is at the managements discretion if alternatives are offered and no credit will be offered if the free item is not required.

 

3: Payment

 

Payment for the goods and delivery charges can be made by any method shown on our shop site at the time the order is placed. Payment must be made before delivery, goods will not be shipped until payment is received.

 

4: Delivery

5: Title of the Goods

 

The goods will become your risk from the moment they are delivered Title of the goods shall not pass to you until the Company has received the payment in full, it is your duty to look after the goods until paid for and we have the right to enter your premises and recover all the unpaid goods. Should you be offered products on a loan basis, it is your responsibility to take care of the product and return immediately the loan period has expired. Failure to do this will result in an invoice being produced for the retail cost of the loan item, and the Title of the goods will then be your responsibility. Loan items that are not returned and charged at full retail cost do not have warranty or technical support. 

6: Title for Business Customers

 

If you are a business customer until ownership of the goods has passed to you, you must:

Store the goods (at no cost to the Company) separately from all your other goods and goods of any third party in such a way that they remain readily identifiable as the Supplier's property, for unpaid goods under our retention of title we will enter your premises and recover all the items on the invoice (full or part) and remove them, if there are items we cannot recover e.g installation or engineering charges we will seek recovery through the High Court.

You must not destroy, deface or obscure any identifying mark or packaging on or relating to the goods; maintain the goods in satisfactory condition and keep them insured on the Companies behalf for their full price against all risks to the reasonable satisfaction of the Company. On request you shall produce the policy of insurance to the Company , and in good condition and keep them insured on the Companies behalf for their full price against all risks to the reasonable satisfaction of the Company. On request you shall produce the policy of insurance to the Company, and Hold the proceeds of the insurance on trust for the Company and not mix them with any other money, nor pay the proceeds into an overdrawn bank account. If you are a business customer your right to possession of the goods shall terminate immediately if:

If you have a bankruptcy order made against you or make an arrangement or composition with your creditors, eg. IVA or otherwise take the benefit of any statutory provision for the time being in force for the relief of insolvent debtors, or (being a body corporate) convene a meeting of creditors (whether formal or informal), or enter into liquidation (whether voluntary or compulsory) except a solvent voluntary liquidation for the purpose only of reconstruction or amalgamation, or have a receiver and/or manager, administrator or administrative receiver appointed of its undertaking or any part thereof, or a resolution is passed or a petition presented to any court for your winding up or for the granting of an administration order in respect of you, or any proceedings are commenced relating to your insolvency or possible insolvency; or You suffer or allow any execution, whether legal or equitable, to be levied on your property or obtained against you or you are unable to pay your debts within the meaning of section 123 of the Insolvency Act 1986 or you cease to trade; or You allow or in any way or use them for security or provide a charge over any of the goods.

Additional services provided such as system design,  networking,  installation and repairs that  have any monies unpaid for whatever reason where a multi depot , shop or distribution centre etc that are all owned by the same person,  partnership, company, LLC , PLC, Charity or Government body exists all services will be withdrawn until the outstanding debts are paid.in full plus any overdue charges, this applies to unpaid monies from any individual depot as long as the invoice is made out to the parent company or owning individual.

 

7: Your right of cancellation

 

You have the right to cancel the contract at any time up to the end of 14 working days after you receive the goods (see below) under the Consumer Protection (Distance Selling) Regulations 2000. To exercise your right of cancellation, you must give written notice to Big Brother Systems Ltd by email to sales@bigbrothersystems.com or by letter giving full details of the goods ordered and delivery details . Exceptions to the Distance selling Regulations are , PLC or Limited Company, Partnership or Sole Trader, or Registered Charities.

If you exercise your right of cancellation after the goods have been delivered to you, you will be responsible for returning the goods to Big Brother Systems Ltd at your own cost. The goods must be returned to the address shown on your invoice within 14 days of advising us of the cancellation. You must take reasonable care to ensure the goods are not damaged in the meantime or in transit and must be returned as you received them and to be in good condition. failure to do so ,means we will charge you for making the product good and supplying any items that are missing. Once you have notified Big Brother Systems Ltd that you are cancelling the contract, you will be refunded or re-credited within 30 days for any sum that has been paid by you or debited from your credit card for the goods.

If you do not return the goods as required, Big Brother Systems Ltd may charge you a sum not exceeding the direct costs of recovering the goods. You do not have the right to cancel the contract if the order contains computer software and the seals have been broken or unsealed by you.

 

8: Warranty

 

All goods supplied by the Supplier are warranted free from defects for the period stated in the product details on the Shop Site at the time of order this is from the date of supply (unless otherwise stated).  We offer a 2year warranty on the majority of our products, see each product to view it warranty period.  If the product has a longer than 1 year warranty and a fault occurs after the expiry of our on site  cover  we will still repair the product but it is your responsibility to return it to us and reinstall after repair,  an offer of extended warranty will not be offered  The warranty does not affect your statutory rights as a consumer.

The warranty does not apply to any defect in the goods arising from:  wear and tear, willful damage, accident, mishandling or negligence by you or any third party, or being used otherwise than as recommended by Big Brother Systems Ltd.  Failure to follow the installation instructions, e.g reverse voltage connection to DC powered Cameras or any alteration or repair carried out without Big Brother Systems Ltd approval will not be covered by the warranty.

Warranty will not be valid if modifications or changes have been carried out to ease installation etc, items include removal of connections from cameras, or breaking of seals on housings, modifications which cause seals to be broken on covers while modifying or repairing the internal electronics of DVR’s, NVR's, Cameras, Power Supplies etc and general mishanding etc. please note all our products are fitted with security seals after final testing, these seals will tear if the product is opened and will invalidate your warranty.

Should any equipment require the cases to be removed to fit upgrade kits, Hard Drives etc please contact our Tech Support before attempting to carry out any modifications to get authorisation in writing, this applies to in or out of warranty equipment.

If the goods supplied to you are damaged on delivery, you should notify Big Brother Systems Ltd by phone or by e-mail within 24 hours..

If the goods supplied to you develop a defect while under warranty or you have any other complaint about the goods, you should notify Big Brother Systems Ltd by phone or by e-mail, as soon as possible, but in any event within 2 working days of the date you encountered the fault.

Note that where applicable all these Terms and Conditions will apply to any other type of sale, either by Phone, Email or in Writing or Visit to our showroom.

 

9: Limitation of Liability

 

Big Brother Systems Ltd will not be liable to you for any loss or damages where The Supplier's total liability in contract, (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise, arising in connection with the performance of this agreement shall be limited to the price paid for the goods, we will also not be liable for any failure to record evidence or data regardless of the cause, be it through equipment fault, incorrect user definable settings or unseen compatability issues, power failure, erratic power, weather condition or any other condition.

There is no breach of a legal duty owed to you by Big Brother Systems Ltd or by its employees or agents, Such loss or damage is not a reasonable or forseeable result of any such breach Any increase in loss or damage resulting from breach by you of any term of this contract.

If you are a business customer Big Brother Systems Ltd shall not be liable to you for any indirect or consequential loss or damage (whether for loss of profit, loss of business, depletion of goodwill or otherwise), costs, expenses or other claims for consequential compensation whatsoever (howsoever caused) which arise out of or in connection with this agreement.

Alternative Dispute Resolution Regulations came into force on 1st October 2015. You have the right to refer a dispute to theretailombudsman.org.uk. 

 

 

10: Data Protection

 

Big Brother Systems will take all reasonable precautions to keep the details of your order and payment secure , none of your details will be passed to a third party for whatever reason.

 

11: Applicable Law

 

These terms of sale and the supply of the goods will be subject to English law and the English courts will have jurisdiction in respect of any dispute arising from the contract.

 

12: WEEE

 

Big Brother Systems Ltd operate and dispose of faulty electronics correctly, we operate a like for like disposal, Camera for Camera, DVR for DVR which safely at no cost to you disposes of faulty electronics correctly.
